Usage Restrictions

All of the content you see and hear on the Birkiland.com web site, including, for example, all of the page headers, images, illustrations, graphics, audio clips, video clips, and text are subject to trademark, service mark, trade dress, copyright and/or other intellectual property rights or licenses held by Birkiland / Upsilon ehf, one of its affiliates or by third parties who have licensed their materials to Birkiland / Upsilon ehf. The entire content of the Birkiland.com web site is copyrighted as a collective work under U.S. & Icelandic copyright laws, and coordination, arrangement and enhancement of the content.

The content of the Birkiland.com web site, and the site as a whole, are intended solely for the personal, noncommercial use by the users of our site. You may download, print or store selected portions of the content, provided you (1) only use these materials for your own personal, noncommercial use, (2) do not copy or post the content on any network computer or broadcast the content in any media, and (3) do not modify or alter the content in any way, or delete or change any copyright or trademark notice.

No right, title or interest in any content or materials is transferred to you as a result of any such activities. Birkiland / Upsilon ehf reserves complete title and full intellectual property rights in any content you download, reproduce, print, redistribute or store from this web site.

Birkiland is a federally registered trademark. Except as noted above, you may not copy, download, reproduce, modify, publish, redistribute, retransmit, publicly display, publicly perform or create derivative works from the content without first obtaining written permission from Birkiland.com / Upsilon ehf.

Contract

Birkiland accepts orders upon receipt of payment for goods ordered. Immediately upon receipt of payment we send you confirmation via e-mail and thereby a legal contract is established between you and Birkiland.

Prices and Taxes

If you are located on Icelandic version of Birkiland all price are with value added taxes but on English version of Birkiland all prices are without value added taxes. If you reside in Iceland, 24.5% VAT is added to the price. Freight costs are added to the original price. Please note that some areas may be outside our shipping range. Information regarding shipping may be obtained in the section labelled “Shipping” which appears later in this document. Customers residing outside of Iceland may find their orders subject to import duties/tariffs. All such costs are paid by the buyer.

Products

We make every effort to display our products in realistic colors. However, we cannot guarantee complete accuracy of the colors as they appear on your computer. This is due to unavoidable technical limitations of web pictures. Furthermore, we make every effort to furnish you with the correct descriptions and dimensions of our products, although small discrepancies may occur.

Cancellations

Cancellations are accepted only if received by Birkiland via e-mail within 4 working days of delivery. The cancellation request must include your name and order number. Such cancellations are accepted without reservations and are fully refundable. In the event the goods are already shipped, the customer is responsible for all shipping costs. The goods must be returned undamaged and in their original wrappings.

We hope that you will be pleased with the goods purchased from us. In the event you receive damaged or defective goods, we guarantee replacement as soon as possible subject to the condition that we are notified within 4 working days via e-mail.

Shipping

All orders are shipped via the Icelandic post office subject to their terms and conditions. The orders are delivered to your home and are shipped within 4-5 working days providing they are in stock. Freight will be charged according to the current prices published by Iceland Post.

Return Policy

In the event you are not satisfied with goods form Birkiland, they can be returned to us within 7 days of arrival. Refund will be issued within 30 days. Receipt must be included with all returned goods. If the goods were damaged in shipping, we request that you save the goods and their original wrappings and contact our website immediately.

You have read and agreed to Birkiland’s privacy policy (see our privacy page).

Governing Law

This contract is in accordance to Icelandic Law and therefore subject to Icelandic jurisdiction in the event that disputes may arise.
